If you don’t identify which parts of your intellectual property are the most commercially viable, you wind up overspending on protecting your IP. Your money and time would have been better spent testing your IP, confirming its value, and setting the stage for a licensing play.
Almost anything can be licensed as long as it has protectable IP rights. The key is knowing which rights to protect. If you don’t know what your IP is, and which parts are the most licensable, you’ll wind up overspending on protecting the wrong parts of your IP. I consulted a woman who created a kids learning assessment toy. It collects data about the kids learning skills by testing them with interactive toys. Not realizing the real value of her IP was the data collection, she spent all her money on patenting the interactive toy “parts”, completely missing the most valuable and licensable part of her IP.
Focus on protecting the most valuable parts first. Those are the ones you’ll want to develop and use for licensing.
